Resolution of Disputes and Measures for Dealing with Violations of Consumer Rights

General Introduction#

When disputes or complaints arise, the Trading Platform encourages negotiation and mediation solutions between parties to reach consensus on resolution methods. If the two parties cannot negotiate with each other and request the Trading Platform to resolve the matter, the Trading Platform's decision is final.

Dispute Resolution Process#

Disputes or complaints will be received and processed by us in the following order:

  • Step 1: The Trading Platform receives complaint and dispute information.
  • Step 2: The Trading Platform verifies the information.
  • Step 3: The Trading Platform acts as a third party to mediate between members (if it is a dispute between Buyer and Seller), or conducts negotiations with members (if it is a dispute between members and the Trading Platform).
  • Step 4: Resolve disputes through negotiation and mediation if negotiation/mediation is successful.
  • Step 5: If negotiation and mediation fail, the dispute will be resolved at a competent People's Court. The court's judgment is binding on the parties.
Disputes Between Seller and Buyer#

+ For disputes arising between Seller and Buyer:

  • Parties must play a responsible role in actively resolving issues.
  • Disputes related to product quality or refund/warranty policies... will be primarily the responsibility of the Seller to resolve with the Buyer. The Trading Platform website is only responsible for acting as an intermediary to receive information from the Buyer – forward information to the Seller, conduct mediation between the Two Parties, and promote the dispute resolution process between the Two Parties.
  • For Sellers: must be responsible for providing documents certifying information related to the matter causing conflict for the Buyer. On the part of the Trading Platform, we will be responsible for providing information related to one member party if requested by the other party.
  • After the Buyer and Seller have resolved the dispute, the parties must be responsible for reporting back to the Trading Platform website management board. In cases where transactions cause conflicts and the fault belongs to the Seller: The Trading Platform will take measures such as warnings, account suspension, or transfer to competent legal authorities depending on the severity of the violation. The company will terminate and remove all product information of that Seller on the Trading Platform website. At the same time, we will require the Seller to compensate and reimburse the Buyer appropriately.
  • If the Seller and Buyer cannot reach an agreement to resolve the dispute, either party has the right to bring the case to a competent People's Court for resolution.
  • We - the Trading Platform always respect and strictly comply with legal regulations on protecting the rights of Buyers (consumers). All fraudulent and deceptive business practices are condemned, and violating parties must bear full legal responsibility.
Disputes Between Members and the Trading Platform#

+ For disputes arising between members (users in general) and the Trading Platform:

  • The Trading Platform has the greatest responsibility in resolving conflicts, mediating, and ensuring member interests. If the conflict is determined to be the fault of the Trading Platform, the website management board will quickly provide a resolution plan to meet the criteria set by the other party. Conversely, if conflicts arise due to member errors, the Trading Platform will send notifications for correction or changes in accordance with Trading Platform regulations to end the conflict, and may apply measures such as warnings, account suspension, or even termination of all their transactions on the website if necessary.
  • If the agreement does not achieve the results desired by both parties, either party has the right to bring the case to a competent People's Court for resolution.
  • The Trading Platform commits to resolving all disputes and complaints on an objective basis, based on contract agreements and legal regulations.
